Steps To Try and Win WSIB Appeal
1. Respond to the WSIB right away and submit an Intent to Object Form
If the WSIB is requesting information, send it right away. If you disagree with a WSIB decision, you need to appeal it right away and make sure you do not miss the deadline to appeal. You can also include any new information and ask the WSIB to reconsider their decision.
The appeal should be filed by completing an Intent to Object Form, which can be found on the WSIB’s website or by using the link.
You should always appeal a WSIB decision, as you will then meet the time limit to proceed with the appeal anytime in the future. If you are not sure what to put in the Intent to Object Form, just put under “Issues in Dispute”: “I am appealing in order to meet the time limitation and may pursue the appeal in the future”.
You do not have to proceed with an appeal after you submit the Intent to Object Form. However, if you want to proceed with an appeal and did not submit the Intent to Object Form within the time limit period, it is difficult to get an extension and you will have to explain to the WSIB why you missed the time limit to appeal.
2. Submit the Appeal Readiness Form once you are ready
After you submit the Intent to Object Form, the WSIB will review it and the decision. They will then forward you an Appeal Readiness Form, which you will have to complete and submit when you are ready to proceed with the appeal.
The WSIB will call and/or write to you if they have any questions, once they review your Intent to Object Form and any new information you submit.
The WSIB should be reviewing this information and processing your appeal within approximately 30 to 45 days. If you do not hear from the WSIB by phone or in writing within 30 to 45 days after you submit your Intent to Object Form, you should call the WSIB and speak with the Case Manager assigned to your file to get an update and make sure they are reviewing your information.
3. Submit evidence for the appeal
Once your file is referred to the Appeals Services Division to assign your appeal, you should start to gather information and evidence regarding your appeal. As an example, if you are appealing a decision that says you have fully recovered from your work accident, you should get any medical evidence you can from a medical specialist, medical professional and family doctor to confirm that you have not fully recovered.
Please note that the medical evidence should be detailed and include:
- Your diagnosis
- Your work restrictions, if any;
- Your prognosis;
- Any medical treatment being recommended; and
- Confirmation or a detailed explanation on how your disability is directly related to your work accident/incident.
It is not useful if your Family Doctor writes a note that says: cannot work due to disability. If you miss the deadline to appeal a WSIB decision, you should send a letter to the WSIB with the Intent to Object Form and ask for an extension of time to appeal the decision. You should also include all of the reasons why you missed the deadline to appeal.
After you send in your Appeal Readiness Form, the WSIB will review it and then refer it to the Appeals Services Division. The Appeals Services Division will then review the form and assign your appeal. The Appeals Services Division will then contact you in writing to let you know whether you will proceed with your appeal by an Oral Hearing (which can be done virtually over the computer or in writing). Please note that it currently (2025) takes approximately 3 to 6 months for an Appeal Readiness Form to be assigned from the date it is received.

Do not assume that the WSIB is handling your appeal. Make sure you call the WSIB to follow up with them, to ensure that your appeal is being reviewed and processed.
